Students

Studying in Spain is a window to the world of work, as foreign students in Spain have the opportunity to do professional internships in large companies. This allows you to gain experience and raise your professional profile, increasing your chances of being hired and changing your status from student to resident.

The entry into force on May 20, 2025, of the new Immigration Regulations, approved by RD 1155/2024, of November 19, has brought about significant changes in long-term residence permits for study, access to work, extension options, visa modification, as well as for family members.

Non-profit residency

Non-lucrative residence is that which allows non-EU foreigners to reside with their families in Spain without working or engaging in lucrative activities.

This residence permit is intended for people who have a certain level of income or savings sufficient to support themselves without actively seeking employment, have no criminal record, and have private health insurance. This residence permit is valid for one year, renewable, and allows you to apply for Spanish nationality on the basis of residence.

Residency by roots

Currently, there are five different types of residence by roots, each with its own specific requirements: family roots; second chance roots; socio-occupational roots; social roots; socio-educational roots; and family roots.

Taking into account each individual's particular situation, they may be eligible for a specific type of arraigo and thus regularize their situation in Spain. It is one of the best alternatives for non-EU foreigners who have been in Spain for a certain period of time in an irregular situation to live and work legally.

The time limits for this required prior stay have been unified following the entry into force of the new Immigration Regulations, set at two years, with the exception of family ties, which do not require a prior period of stay and which, in this new regulatory text, include direct relatives of minors who are nationals of another Member State of the European Union, the European Economic Area or Switzerland who can prove that they reside with them in Spanish territory, and family members who provide support to a person with a disability in the exercise of their legal capacity, who is a national of a Member State, the European Economic Area or Switzerland and lives with them.

New Regime for family members of spanish citizens

The entry into force of the new Immigration Regulations has created a specific category for family members of Spanish citizens, called “Temporary residence permit for family members of Spanish nationals.” This type of residence is now regulated as a separate category, outside the regime for family members of European Union citizens and family ties.

It is a permit with an initial duration of five years, which allows the holder to work for someone else and/or on their own, renewable for periods of five years; and which expands the options for reunification, mainly to descendants up to the age of 26, as well as to the family member-caregiver of the dependent Spanish citizen or to the extended family, who can prove economic or social dependence. On the other hand, in the case of ascendants of Spanish citizens, they must prove that they are dependent, unless they are over 80 years of age.

Community citizens and their family members

This section covers the conditions for the exercise of the rights of entry and exit, free movement, stay, residence, and work in Spain by citizens of other Member States of the European Union, those of the Agreement on the European Economic Area (Iceland, Liechtenstein, and Norway), and Switzerland, as well as their family members.

EU citizens who are going to reside in Spanish territory for a period of more than three months are required to apply for registration in the Central Register of Foreigners, and will be issued with a registration certificate. This certificate will allow them to work for someone else or start a business in Spain.

Non-EU family members of EU citizens must apply for a residence card for family members of EU citizens. This card allows them to work for someone else or on their own and is valid for five years and can be renewed.

Mixed marriages

Marriages between people of different nationalities or marriages celebrated abroad by Spanish nationals are completely valid. Likewise, foreigners residing in Spain also have the possibility of getting married in the country. However, they raise special issues of capacity, consent, and form that do not arise in marriages that do not have this foreign element.

International Mobility

The approval in 2013 of the so-called Entrepreneurs Law or Law 14/2013 brought with it important changes in the way foreign citizens could obtain residence in Spain through different types of visas or residence permits: investors, entrepreneurs, highly qualified personnel, researchers, intra-company transferees, and digital nomads.

This law has undergone a significant amendment through Organic Law 1/2025 of January 2 on measures to improve the efficiency of the Public Justice Service, whose Final Provision Twenty-One eliminates all investor visas (purchase of real estate, bank deposits, investment funds, or public debt).

The following remain in effect:

Residence for highly qualified professionals: allows foreign workers to carry out work that requires a higher education qualification or a minimum of three years' professional experience in the sector.

Residence for entrepreneurs: any foreigner who wishes to carry out an innovative entrepreneurial or business activity and has a special economic interest in Spain may apply for this type of residence permit.

Residence for researchers: for those who wish to carry out training, research, development, and innovation activities in public or private entities established in Spain and who have an offer to carry out such activities.

Residence for intra-company transfers: covers foreigners who move temporarily to Spain within the framework of an employment, professional, or training relationship, from a company outside Spain to a company or group of companies established in Spain.

Residence as an international teleworker or digital nomad: allows non-EU foreign nationals to live and work remotely for companies located outside the national territory through computer, telecommunications, and telematic systems and means.

Nationality

Spanish nationality is the legal status held by those born in Spanish territory and those foreigners who meet the necessary requirements.

You can apply for Spanish nationality in various ways, depending on your personal situation: nationality by residence, by option, by simple presumption, by Letter of Naturalization, and nationality under the Democratic Memory Law or the Grandchildren's Law.
